Terms & Conditions

This Contract for a short-term holiday letting (in accordance with Schedule 1, Part I, section 9 Housing Act 1988) is between the owners of Compton Pool (“us” or “we”) and those staying or agreeing to stay at Compton Pool (“you”). The property let is one or more of the cottages or houses comprising Compton Pool (“the property”). The person making the booking (‘the booker”) certifies that all members of the holiday party are aware of the terms and conditions of this contract and agree to be bound by them. All members of the party are jointly and severally liable under it. They agree that all communication with them can be through the booker. This contract has been made within England and Wales. Your submission of a booking form constitutes an irrevocable offer to enter into a contract, which will be complete when we have accepted your booking (as distinct from merely acknowledging receipt of your booking request). This acceptance will include a payment, in part or in-full by you for your holiday unless we have specifically waived this requirement. Any of the terms of this contract may be varied by specific agreement in writing. The client should check the booking form carefully to make sure all details are entered correctly

Payment

A non-refundable deposit of 25% of the booking is payable if the booking is made more than 8 weeks before the start of the rental. The balance will be payable 8 weeks before the commencement of the rental. Non-payment of the balance of the rental on or before the due date shall be deemed as cancellation of the contract by the client. For bookings made less than 8 weeks prior to commencement of the rental the total non-refundable fee is payable at the time of booking. All payments should be made to Compton Pool at the address at the bottom of the booking form. Payment may be made by card or bank transfer.

VAT
VAT is included in the rental charge of the property. VAT registration No. 386 960 835.

Changes to bookings
Compton Pool will consider any request to change dates or cottage choice after confirmation has been issued. It reserves the right to charge an administration fee of £50 plus VAT in the event a change to the booking is made. These changes are at the discretion of the owners.

Period of Hire

Rental commences at 4pm on the day of arrival and terminates at 10am on the day of departure.

Security Deposit
We reserve the right, at our discretion, to charge a refundable damage deposit for any booking. We always do so for group bookings. We have the right to retain all or part of the deposit in the event of damage, excessive cleaning, breakages or other loss to us by breaches of this agreement. This does not affect our right to claim further if the deposit is insufficient compensation.

Occupancy and use of property
The number of persons occupying the property must not exceed the maximum number as shown in the website. In addition to the maximum occupancy one cot per property will be made available on request. The property shall be used for personal and domestic purposes only. The property shall not be used for any commercial purpose. Bookings will not be accepted for ‘Hen or Stag Parties’.

Cancellation
Any cancellation for whatever reason should be made in writing to Compton Pool. On receipt of cancellation, Compton Pool will seek to re-let the property for the period of the booking. If Compton Pool are successful in obtaining a booking for the whole period it shall refund all monies paid at the time of cancellation less a £50 (Plus VAT) administration fee. If Compton Pool is only able to re-let the property for part of the period cancelled it shall refund an amount equal to the money paid less the rental for the period which is not re-let and less the administrative fee as detailed above. If Compton Pool is unable to re-let the property for any period no refund will be due. Further, any outstanding balance due for the booking shall be deemed as payable. 

If your booked accommodation at Compton Pool is ready and available for you to stay in, but you are entirely prevented from using it by some unforeseeable event totally beyond your control, then in no circumstances will you be entitled to repayment/refund of any money already paid to us. 

Compton Pool recommends that clients should take out Holiday Insurance Cancellation cover as a precaution for unforeseen circumstances

Cancellation By Us
We retain the right to cancel your holiday in advance for any reason which seems to us sufficient, including circumstances beyond our control such as fire, flood, or damage to the property, in which case you will be repaid money paid to us by you for the holiday in full. If we have to terminate your holiday part way through for such a reason you will be refunded part of the amount pro rata based on the time remaining of the booking. No additional compensation, expenses or costs will be payable by us to you in any circumstances.

Compton Pool Closure due to COVID-19 regulations
If Compton Pool is closed due to government COVID-19 regulations, or the lead bookers address is in a local lockdown at the time of your holiday, we will allow you to use the amount you have paid to date against a future holiday with us of your choosing. 

 There are several suitable travel insurance options which include cover for COVID-19 related cancellation such as a positive test or isolation requirement (see below), or you can look for suitable cover on comparison sites such as www.gocompare.com. Compton Pool is not selling, promoting, endorsing or recommending any particular product, and does not benefit financially from, or have any formal relationship with any of the providers.

Services and Facilities
Services and facilities can be interrupted or break down, particularly in a rural setting. In the absence of electricity supply or other essential service, in such circumstances that the holiday cannot reasonably take place or continue, you will be offered the opportunity to curtail your holiday with an appropriate refund on a pro-rata basis. 

The absence of non-essential services such as television or wi-fi or problems with non-essential facilities including pool will not be a good reason to terminate the holiday or seek a refund. We have a discretion to distinguish in these cases between the essential and non-essential. 

We will make every effort to sort out all such problems as quickly as possible.

Rules and Procedures
Clients are required to familiarise themselves with and observe the rules and procedures of Compton Pool  contained within the Information Book in each property.

Use of the Facilities
The communal facilities at Compton Pool are strictly reserved for the use of clients and the owners of the property and their immediate family. Clients guests may use the facilities only with specific approval of Compton Pool and for which a charge may be made at its discretion. Any of the on site facilities may be withdrawn from use by Compton Pool in the event of any circumstances which deem the facilities unsafe or present any risk to health and safety. The facilities will be withdrawn in the event of any misuse or failure to comply with rules and procedures.

Compensation
Except where otherwise stipulated by law, no compensation, expenses, costs or refund for whatever cause will in total exceed the cost paid by you to us for the holiday.

Care of the Property
You must take reasonable care of the property and its contents as well as the facilities, outbuildings, grounds and livestock. 

You must not cause damage or breakages beyond normal wear and tear. 

You must not move furniture and must leave items as far as possible where you found them. 

In the event of a group booking you must not move items (Crockery, glassware, furniture etc) between properties without being sure to replace them. 

You must leave the property reasonably clean and tidy and leave them in the same state of repair and condition as at the start of the rental.

Breakages or Damage
The client is required to notify Compton Pool in the event of any breakages or damage caused to the property or contents. Compton Pool reserve the right to demand full payment for such breakages or damage.

Smoking
Smoking is entirely forbidden in the property or in any building(s) on site. You may be charged for any extra cleaning arising out of breach of this condition.

Guests
Details of guests must be supplied to us at the time of booking on the booking form or as soon as possible thereafter in the event of any agreed change. Those guests so detailed are those who may stay in the property. The number of guests cannot exceed the maximum number advertised for the property. If you wish to invite non-residents on site, this must be cleared with us first. Use of the pool or other facilities by non-residents will be consented to sparingly.

Pets
You may not bring any pets with you to Compton Pool except for dogs agreed and paid for in advance. We have a separate Dog Policy which must be observed.

Dogs are permitted in The Farmhouse, Torr cottage, Crazywell, Wray and Kester and charged at £50 per dog per stay (maximum of 2 dogs in each cottage and maximum 1 dog in Crazywell)

A refundable dog deposit of £150.00 (£250 for The Farmhouse) is required 8 weeks prior to your arrival. This is for any damages caused.

Please note the area we are in has red soil/mud. Please clean/wash and dry down your dog(s) prior to entering the cottages. Should the red soil/mud get on the bedding, this will not come out and charges will be deducted from your deposit. Should the damage be more that the amount states, the remaining amount must be paid.

Dogs are not permitted in the bedrooms and are allowed on sofas only when covered with a throw. Dogs must not be left unattended during the day with free access around the cottage. Dogs must be on a lead at all times within the complex and all dog poo must be picked up.  We have special areas for you to walk your dog(s), which they may be off their lead(s).

We reserve the right to charge for any damage caused by your dog whilst staying in the cottage.

Compton Pool will take no responsibility or liability for guests dogs and all dogs should be insured by their owners, in an event of an incident.

Liability

Compton Pool and its employees shall not be liable to the client or third parties for any accident, damage, loss, injury, expense or inconvenience which may be suffered, arise out of or in any way connected with the rental. No term of Contract is enforceable under the Contracts (Rights of the Third Parties) Act 1999 by a person who is not a party to the Contract. If the property which the client has booked becomes unavailable for some reason prior to the date of booking then Compton Pool’s obligation will be to use their best efforts to offer an alternative property or failing which the client will be reimbursed for any monies paid.

Warranties
Compton Pool does not warrant and is not responsible for the accuracy of any verbal information given or statements made by its employees or agents.

Right of Entry
Compton Pool (and workmen and others authorized by us ) reserves the right to enter the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

Behaviour
You must act with consideration for other guests.

Please have a good time but don’t act to the annoyance of others. We are in the peaceful countryside. Children go to bed early.

In particular there must be no –Noise–no excessively loud music or music played outside, repeatedly barking dogs, late night revelry outside etc

Offensive behaviour such as loud swearing, nudity etc

Dangerous, threatening, unlawful or illegal behaviour.

Breach
If you repeatedly breach or very seriously breach (of which we are the sole judge) these terms during your holiday we may require you to leave at once without compensation. In this case your letting is terminated at once and if you fail to leave you will be charged accordingly.

Fire Safety
Candles, fireworks, indoor smoking and similar fire hazards are not allowed.

Children’s Colouring Items
Felt and fibre tipped pens, paints and wax crayons cause damage. Please do not bring them. We have lovely pictures drawn for us by guests’ children with ordinary crayons.

Complaints
You should raise any problems or concerns during your stay as soon as you are aware of them. We can then assess the situation and put things right as soon as possible. We will not entertain complaints made after leaving which we could have addressed during your stay. We do have a complaints procedure, will take any complaint seriously and will do everything we reasonably can to resolve it to your satisfaction.

Data Privacy
Unless you have indicated otherwise during the booking process, you may receive occasional promotional emails from us. You may at any time decline to receive more. We will not pass your data to anyone else.

Force Majeure
We do not cover you for your holiday being unavailable due to natural disasters, terror attacks, acts of war, hijacking, riots, incidents of civil unrest, pandemics, epidemics, or general restrictions on movement imposed by local or national government, which may prevent you from taking your holiday. We would strongly advise that guests take out a travel insurance policy which covers booking cancellations. This is available at very affordable rates, and gives you the peace of mind that you will get your money back if you need to cancel your holiday. If you choose not to then you accept responsibility for any loss that you may incur due to your cancellation.

Important Information

Guest Safety and disabled access
The cottages at Compton Pool have all been developed from farm buildings and clients should be aware that not all cottages will have current safety and design features. Cottages suitable for occupancy by disabled persons are indicated on the website, but guests should be aware that this does not imply the cottages include all equipment designed specifically for disabled guests rather than access is suitable. All cottages have mains wired smoke detectors with battery backup. Each cottage is supplied with fire extinguishers and fire blankets.

The windows are unlocked. If you require them to be locked, keys can be provided on request.

Please do not let your children go into the animal pens. Should you (adult(s) or child(ren)) enter the animal pens, this is at your own risk and Compton Pool, will not be liable for any injury caused by the animals.

Inventory
All cottages are equipped with equipment deemed necessary for the purpose of holiday accommodation. Details of fixtures and fittings are described on the website. Cots and highchairs are all available on request at no charge and requirements should be made on the booking form.

Towels and Linen
All bed linen, towels and kitchen towels are supplied. We do not provide swimming/beach towels and cot bedding (pillow and duvet)

Heating/Electricity
Each cottage’s hot water and heating are supplied from the Biomass boiler, this and the electricity supply are included in the rental.

Facilities
Use of the swimming pool is restricted to the hours of 7am to 9pm. On Fridays it is 4pm to 9pm. All other facilities can be used at all reasonable times, but Compton Pool reserve the right to restrict use if it considers any activity may disturb other guests.

Telephones
There is a limited mobile phone signal on site, (service is poor in most cottages). You can usually make calls using your WiFi calling once you have logged onto our WiFi.

Service Cleans
Service cleans and change of bed linen and towels will be provided for guests staying for 8 nights or more. Should you require a change of bed linen or towels during your stay, this is to be arranged prior to your arrival and there will be an additional cost to this service.  Please enquire with us for prices.
